El despido intempestivo ha sido uno de los causales con mayor incidencia en el tema laboral, debido que el patrono no establece condiciones claras de la desvinculación, por lo que, se vulnera los derechos de los trabajadores. Elaborar un documento de análisis jurídico crítico que evidencie como la incidencia del despido intempestivo vulnera los derechos laborales Constitucionales en el Ecuador. El artículo fue una revisión sistemática con un diseño transversal. Para la busqueda de información se utilizó las principales platafomas digitalez (...) con evidencia científica en el campo jurídico, además de establecer criterios de inclusión y exclusión para obtener la información con mayor relevancia al estudio. De acuerdo con los casos analizados se evidenció que los despidos intempestivos se los realiza sin una justificación clara, que motive la desvinculación del trabajador vulnerando su derecho a tener una estabilidad laboral, un trabajo digno. A pesar de que la Constitución y las leyes laborales establecen claras protecciones para los trabajadores, la realidad demuestró que estas normativas no siempre se aplican de manera efectiva, lo que no solo socava el derecho a la estabilidad laboral y un trabajo digno, sino que también limita el acceso a la justicia, afectando el bienestar tanto económico como psicoemocional de los dependientes, destacando la necesidad urgente de fortalecer los mecanismos de protección laboral, garantizando la aplicación rigurosa de las leyes existentes en Ecuador. En este artículo pretendemos estudiar la dependencia de la percepción respecto a los marcos conceptuales del sujeto percipiente, lo cual supone la historicidad de la percepción. Para ello, comentaremos las formas de comprender el cerebro que justifican neurocientíficamente esta posibilidad, en las que el concepto de plasticidad es central. Asimismo, deseamos comentar cuáles son las posibilidades que abre el hecho de la dependencia de la percepción respecto a la teoría, posibilidades que en el ámbito filosófico continental tienen una dimensión marcadamente (...) política. En este artículo pretendemos demostrar la existencia de una teoría de la propiedad en la obra de Joaquín Costa. Esta subyace tanto en sus escritos dirigidos a influir en la política de su tiempo como en sus estudios filosóficos de otros autores. En ese sentido, trataremos de discernir cuál es el posicionamiento de Costa entre todos aquellos que estudia, así como de mostrar con exactitud cuáles son los orígenes de la teoría de este autor, los cuales se pueden localizar en (...) la teología política del catolicismo social, las prácticas colectivistas del mundo agrario español y los autores de la que denomina escuela española del derecho. En ese sentido, aclararemos cuál es el lugar de la teoría económica costista ―el colectivismo agrario― entre las teorías modernas de la propiedad, singularmente en su relación con el socialismo. Finalmente, mostraremos la estrecha relación entre propiedad y derecho consuetudinario en Costa. Todo ello nos servirá para mostrar la posibilidad de entender a Costa como un autor fértil para la tradición progresista española. (shrink)

In the present work, we propose to explore the passage from critique to commodity fetishism and, in general, of capital in Karl Marx to the critique of the fetishism of power in Enrique Dussel. Marx's category of fetishism and its use in the political field has been suggested by the Latin American philosopher for the negative critique moment of his Politics of Liberation, however, it has not been explicitly developed in his passage from the economic field to the political field. (...) We think that its explicit thematic treatment is important since it seems to us the central category in the critique of politics and the possible alternatives towards a new order. The text is presented in three parts: The first part reviews the historical necessity of the State form and its inevitable possibility of fetishization. In the second one, it recovers the category People and their Will-of-life as anti-fetishist fundament of the political power. And, in the third, we made the exposition of the logical passage from the economic field to the political field, that is, from the fetishism of capital to the fetishism of power between Marx and Dussel. En el presente artículo pretendemos estudiar la posible participación de las poblaciones migrantes en la condición postfotográfica. Igualmente, comentaremos desde la teoría de la postfotografía tres imágenes y obras audiovisuales ligadas a la migración en el siglo XXI. A través de ellas, se mostrará la posible aplicación del concepto de postfotografía a obras relacionadas con la migración. The humanitarian action carried out by the Local Police in the different shanty towns of foreigners in the Huelva area, specifically in the town of Moguer, has been extraordinary. Coordinated at all times with the City Council of Moguer and the Social Services of the municipality, where an unprecedented plan of action was developed to alleviate the basic needs of foreigners living in subhuman conditions in the middle of nature.

Returning to sport after the sports injury is a difficult decision because it’s multicausal and the fact that a rash decision can result in numerous negative consequences. Given the importance of psychological variables for the correct rehabilitation of the injured athlete and his or her optimal return to sports practice, there seems to be little information on this subject. In this sense, the objective is to determine the relationship between the subjective psychological disposition of the athlete in the process of (...) Return to Play with the type of mood profile and his mental health. This is based on the fact that each athlete evaluates his or her recovery differently and has different levels of anxiety, depression, and stress. For this purpose, four athletes participated in the study. Two males and two females from the sports of indoor soccer and soccer, who had just returned to sports after a moderate or severe injury. The average age was 24.25 years. Various measurements were taken after practices and after matches, to assess mood, psychological readiness, anxiety, stress, and depression. The results confirm Morgan’s iceberg profile and the influence that subjective psychological perceptions and assessed emotional states have on athletes’ incorporation into their sports practice with a guarantee of success. ABSTRACT In their answers to questions regarding "personal moral dilemmas", patients with lesions to the Frontal Cortex -FC- or Ventromedial Prefrontal Cortex -vmPFC- display a disposition to directly injure another person in order to save lives, thus revealing a possible lack of empathy. However, their answers are normal when they evaluate behaviors lacking in empathy but without a utilitarian justification. We here defend that those patients suffer from a cognitive deficiency associated with Damasio's somatic marker hypothesis and with value judgments. The article critiques the "utilitarian patient" hypothesis that has become deeply rooted in cognitive neuroscience. This paper explores the fundamental theses of the capabilities approach and differentiates it from notions of development that are more focused on the generation of wealth and growth. The paper emphasizes the importance of action in the development of life projects and describes the importance of emancipation in exercising freedoms. It then describes the education challenges from the perspective of the capabilities approach. It situates the importance of this approach in the Latin American context, where freedom is closely linked to (...) the pursuit of social justice. This work analyses the speech-act of arguing as proposed by Linguistic Normative Model of Argumentation (LNMA) with the help of diagrams, examples and basic formalization techniques. The focus is set on one of the most novel issues of LNMA, modal qualification, and the distinction between epistemic and ontological modals. The first conclusion is that employing LNMA in order to analyse and evaluate actual argumentation as it is proposed is too complex to be applied as is. Background: COVID-19 has taken many lives worldwide and due to this, millions of persons are in grief. When the grief process lasts longer than 6 months, the person is in risk of developing Complicated Grief Disorder. The CGD is related to serious health consequences. To reduce the probability of developing CGD a preventive intervention could be applied. In developing countries like Mexico, the psychological services are scarce, self-applied interventions could provide support to solve this problem and reduce the health impact (...) even after the pandemic has already finished.Aims: To design and implement a self-applied intervention composed of 12 modules focused on the decrease of the risk of developing CGD, and increasing the life quality, and as a secondary objective to reduce the symptomatology of anxiety, depression, and increase of sleep quality. The Intervention Duelo COVID follows the principles of User Experience and is designed according to the needs and desires of a sample of the objective participants, to increase the adherence to the self-applied intervention, considered one of the main weaknesses of online interventions.Methods: A Randomized Controlled Trial will be conducted from the 22nd of December of 2020 to the first of June 2021. The participants will be assigned to an intervention with elements of Cognitive Behavioral Therapy, Acceptance and Commitment Therapy, Mindfulness and Positive Psychology. The control group will be a wait-list condition, that will receive the intervention 1.5–2 months after the pre-measurement were taken. The Power Size Calculation conducted through G*Power indicated the need for a total of 42 participants, which will be divided by 21 participants in each group. The platform will be delivered through responsive design assuring with this that the intervention will adapt to the screen size of cellphones, tablets, and computers.Ethics and Dissemination: The study counts with the approval of the Research Ethics Committee of the Autonomous University of Ciudad Juárez, México, and it is registered in Clinical Trials. The article is sent and registered in clinical trials before the recruitment started. The results will be reported in future conferences, scientific publications, and media. (shrink)

Our main objective here is to show the methodological usefulness of philosophical ideas. Concretely, drawing on theoretical analyses related to the concept of social structuring processes (Elder-Vass) and becoming differently (Gilles Deleuze), we argue that the social struggles of Afro-Latin American women can be interrogated in their role of transforming normative identities and fostering innovative communitarian dynamics that enable adaptation and transformation. The central thesis is that embracing a social construction perspective characterised by fluidity, adaptability, and solidarity can offer an (...) alternative philosophically grounded methodological framework capable of addressing the complexities of race, gender, and social justice in Latin America. In the context of the recent necessity to rethink mobilisation and social movements, our findings highlight the significance of structuring processes over identity differentiation and the importance of networked activities in facing systemic challenges. Ultimately, this study contributes to the possibility of moving towards more complex accounts of the plurality communitarian arrangements becoming active in the middle of reality changes and mutual efforts to deal with them. Recent research has shown that cultural, linguistic, and sociodemographic peculiarities influence the measurement of trait emotional intelligence. Assessing trait EI in different populations fosters cross-cultural research and expands the construct’s nomological network. In mental health, the trait EI of clinical populations has been scarcely researched. Accordingly, the present study examined the relationship between trait EI and key sociodemographic variables on Trait Emotional Intelligence Questionnaire datasets with mental healthcare patients from three different Spanish-speaking countries. Collectively, these datasets comprised 528 participants, 23% (...) from Chile, 28% from Peru, and 49% from Spain. The sociodemographic variables we used for trait EI comparisons were gender, age, educational level, civil status, and occupational status. Analyses involved Multigroup Exploratory Structural Equation Modelling and analysis of covariance. Our results revealed significant between-country differences in trait EI across the studied sociodemographic variables and interactions between these variables. Measurement invariance across the datasets was attained up to the scalar level regarding gender and education, although analyses on age, civil status, and occupation displayed non-invariance. The resultant psychometric evidence supports the suitability of the TEIQue-SF for the accurate cross-cultural assessment of trait EI in mental health settings. It also highlights the importance of incorporating trait EI into extant psychotherapeutic frameworks to enhance non-pharmacological treatment efficacy. (shrink)

Research targeting emotion’s impact on relational episodic memory has largely focused on spatial aspects, but less is known about emotion’s impact on memory for an event’s temporal associations. The present research investigated this topic. Participants viewed a series of interspersed negative and neutral images with instructions to create stories linking successive images. Later, participants performed a surprise memory test, which measured temporal associations between pairs of consecutive pictures where one picture was negative and one was neutral. Analyses focused on how (...) the order of negative and neutral images during encoding influenced retrieval accuracy. Converging results from a discovery study (N = 72) and pre-registered replication study (N = 150) revealed a “forward-favouring” effect of emotion in temporal memory encoding: Participants encoded associations between negative stimuli and subsequent neutral stimuli more strongly than associations between negative stimuli and preceding neutral stimuli. This finding may reflect a novel trade-off regarding emotion’s effects on memory and is relevant for understanding affective disorders, as key clinical symptoms can be conceptualised as maladaptive memory retrieval of temporal details. A lo largo de la historia el ser humano ha sentido interés por el fenómeno del movimiento y su vínculo con la ilusión de vida; diferentes mecanismos y sistemas articulados se han construido con el fin de insuflar vida en seres inertes. El presente artículo reflexiona sobre la cualidad móvil del acto creador presente en diferentes campos socioculturales, desde el misticismo hasta los avances tecnológicos. Se parte del enigma del anima, y su conexión con los creadores, denominados ejecutantes y sus (...) creaciones, denominadas “avatares encarnados”. Se analizan las relaciones de control-libertad, dependencia-independencia entre el ejecutante y su “avatar encarnado”; como también el grado de aceptación que tiene la audiencia al ver las creaciones reproducidas bajo el dispositivo diacrónico. La transición del autómata al personaje animado constata la evolución de los sistemas de representación y reconocimiento del movimiento. (shrink)

Esta obra se concentra en cuatro temas cruciales de la formación de docentes, tanto antes como durante el servicio y en la enseñanza en diferentes áreas y niveles educativos. En primer lugar, se aborda el asunto de las creencias que los docentes tienen sobre el proceso educativo, las cuales parecen influir en la práctica profesional que estos desarrollan y, por lo tanto, deberían recibir la atención explícita de los procesos de formación de docentes que deseen promover prácticas específicas. El segundo (...) tema de la obra es la relación entre la formación de docentes y la política pública que la rige. En particular, se analizan las reformas curriculares implementadas por varias licenciaturas en universidades privadas colombianas, en respuesta a reformas a la normatividad sobre las condiciones de calidad que a las que deben ajustarse todas las licenciaturas del país. El tercer tema analizado es en qué medida los docentes en educación superior van más allá del dominio de su saber disciplinar atribuyendo importancia a la pedagogía, la didáctica y la práctica reflexiva en su propia práctica docente. Finalmente, se discuten aspectos de la formación de docentes relacionados con los procesos vividos y los retos encontrados por los docentes al entrar en la profesión, su socialización en la comunidad docente, sus identidades como maestros y su motivación para ser docentes. Vale la pena señalar que las contribuciones a este libro comparten el uso de metodologías cualitativas y presentan los resultados de historias de vida, entrevistas, observaciones, y análisis documentales, entre otros. Twitter sirve plataforma a movimientos feministas como #MeeToo y potencia el uso del lenguaje inclusivo con textismos específicos que utilizan la -@ y -x como marca de género inclusivo. Se estudia el uso de docentes que trabajan con adolescentes de estas marcas en comunidades educativas virtuales en Twitter mediante minería de datos y análisis de texto. Los resultados muestran un elevado uso de -@ y -x entre los docentes en sus interacciones, lo que los convierte en modelos de la adopción (...) de propuestas lingüísticas innovadoras por la igualdad que posteriormente pueden ser adoptadas por los adolescentes en sus comunicaciones digitales. Desde una visión holística (...) del pensamiento filosófico cubano se revela la complejidad de un fenómeno multifactorial, la cubanía, como construcción cultural, a partir de la articulación de la concepción martiana y marxista de la cultura y los valores, lo que constituye un acierto del quehacer teórico - práctico marinelliano. El conocimiento de esta perspectiva enriquece los estudios sobre la obra de este intelectual y contribuye a dilucidar el devenir ideo-artístico y cultural cubano. The result of the research focuses on one of the priorities of the territorial and national scientific pole line: the need to recover the role of Cuban intellectuals during the Republic. The role of culture and Cubanism in Juan Marinello's philosophical world view is analyzed. The method used presupposes a dialectical analysis of reality, based on a critical perspective which allows to interpret and enrich the understanding of events and historical processes. From a holistic point of view of the Cuban philosophical thinking, Cubanism, a complex multifactorial phenomenon, is revealed as a cultural construction, starting from the articulation of Marti's and Marx's conception of culture and values, which is a good result of Marinello's theoretical-practical work. The knowledge of this perspective enriches the studies on the work of this intellectual and contributes to the clarification of the Cuban ideo-artistic and cultural evolution. (shrink)

Research has found that both cisgender and transgender androphilic males (i.e., males sexually attracted to and aroused by other adult males) have female-typical occupational preferences when compared with gynephilic males (i.e., males sexually attracted to and aroused by adult females). Moreover, whereas cisgender androphilic males’ occupational preferences tend to be intermediate between those of gynephilic men and androphilic women, transgender androphilic males tend to have occupational preferences that are more similar to androphilic women. No study has directly compared both types (...) of androphilic males within the same culture. The present study investigated occupational preference and its relation to childhood sex-atypical behavior (CSAB), among gynephilic men (_n_ = 208), androphilic women (_n_ = 138), and cisgender (_n_ = 132) and transgender (_n_ = 129) androphilic males from the Istmo region of Oaxaca, Mexico, where androphilic males are recognized as third gender, _muxes_. The study found large sex differences in occupational preferences (_d_ = 2.80). Furthermore, both cisgender _muxe nguiiu_ (_d_ = 2.36) and transgender _muxe gunaa_ (_d_ = 3.44) reported having more sex-atypical occupational preferences compared with men. However, _muxe gunaa_ reported higher female-typical occupational preferences than women (_d_ = 0.59) and _muxe nguiiu_ (_d_ = 0.57), whereas _muxe nguiiu_ and women did not differ (_d_ = 0.08). These findings are consistent with the conclusion that sex-atypical occupational preferences are a cross-culturally universal aspect of male androphilia. Finally, CSAB was associated with sex-atypical occupational preferences among all participants. These findings suggest that a developmental continuity exists between childhood and adulthood sex-atypicality. (shrink)

Hidden cluster problems can manifest when broad ethnic categories are used as proxies for cultural traits, especially when traits are assumed to encode cultural distances between groups. We suggest a granular understanding of cultural trait distributions within and between ethnic categories is fundamental to the interpretation of heritability estimates as well as general behavioral outcomes.

BackgroundMoral distress (MD) is the psychological damage caused when people are forced to witness or carry out actions which go against their fundamental moral values. The main objective was to evaluate the prevalence and predictive factors associated with MD among health professionals during the pandemic and to determine its causes.MethodsA regional, observational and cross-sectional study in a sample of 566 professionals from the Public Health Service of Andalusia (68.7% female; 66.9% physicians) who completed the MMD-HP-SPA scale to determine the level (...) of MD (0-432 points). Five dimensions were used: i) Health care; ii) Therapeutic obstinacy-futility, iii) Interpersonal relations of the Healthcare Team, iv) External pressure; v) Covering up of medical malpractice.ResultsThe mean level of MD was 127.3 (SD=66.7; 95% CI 121.8-132.8), being higher in female (135 vs. 110.3; p<0.01), in nursing professionals (137.8 vs. 122; p<0.01) and in the community setting (136.2 vs. 118.3; p<0.001), with these variables showing statistical significance in the multiple linear regression model (p<0.001; r2=0.052). With similar results, the multiple logistic regression model showed being female was a higher risk factor (OR=2.27; 95% CI 1.5-3.4; p<0.001). 70% of the sources of MD belonged to the dimension "Health Care" and the cause "Having to attend to more patients than I can safely attend to" obtained the highest average value (Mean=9.8; SD=4.9).ConclusionsFemale, nursing professionals, and those from the community setting presented a higher risk of MD. The healthcare model needs to implement an ethical approach to public health issues to alleviate MD among its professionals. (shrink)

Previous research indicates that Euro-American women are more upset by imagining their male partners committing homosexual infidelities than heterosexual ones. The present studies sought to replicate these findings and extend them to two non-Western cultures wherein masculine men frequently engage in sexual interactions with feminine third-gender males. Across six studies in three cultural locales, women were asked to rate their degree of upset when imagining that their partner committed infidelity that was heterosexual in nature, as well as infidelity that was (...) homosexual. In two Canadian undergraduate samples, women reported greater upset at imagining partner infidelity with a female, whereas a community sample of middle-aged women reported equal upset across infidelity types. Samoan women reported substantially less upset at the thought of partner infidelity with a third-gender male than with a female. Istmo Zapotec women reported equal upset toward infidelity with a female or a third-gender male, whereas a second Zapotec sample reported slightly greater upset at the thought of infidelity with a muxe. Results illustrate how cultural contexts moderate the degree to which same-sex infidelity scenarios are upsetting to women. (shrink)

Los interesantes aportes del Prof. Ramírez Gómez tratan sobre el papel que el mercado debe jugar en una sociedad democrática, y con este propósito sugiere que éste debería responder a las preferencias del gobierno y no a las preferencias individuales. Nuestra réplica amistosa plantea que este argumento debe ser ampliado para evitar interpretaciones que lo confundan con las fórmulas experimentadas por las economías de planificación total, que han mostrado su ineficiencia en la provisión de valores de uso pertinentes. The present study examined women’s mate competition tactics in response to female and feminine-male rivals in two cultures in which competition against both occurs. In Samoa and the Istmo Zapotec (Southern Mexico), women not only compete with other women (intrasexually) but also compete with rival feminine males (_intersexually_) in order to access/retain the same masculine men as sexual/romantic partners. Using a mixed-method paradigm, women were asked about their experiences of intra- and intersexual mate competition, and these narratives were recorded. The (...) tactics reportedly employed by participants, and those attributed to mate competitors, were categorized according to established taxonomies of mate competition tactics, and their frequencies compared. Within-culture, the likelihood that participant women had ever experienced intra- and intersexual mate competition did not differ. Furthermore, participants reported a similar pattern of behavioral tactics whether their rival was another woman or a feminine male. These included benefit provisioning tactics during mate acquisition and cost-inflicting tactics during mate retention. Similarly, the mate competition tactics attributed to rival women and rival feminine males bore a striking resemblance, focused on enticing target men. Results highlight the mate competition tactics employed by women outside of a Euro-American context, and the way cultural factors impact mating landscapes presumed to be exclusively heterosexual. The presence of feminine males, alongside masculine men’s willingness to engage in sexual activity with them, induces women in such cultures to compete intersexually in comparable ways to intrasexual competition with rival women. Paul Klee’s sense of modern art and his own painting as the channeling of the originary movement of life leads to an insight beyond modern art, and back towards such dynamic cosmological experiences as that of the Onas people of Patagonia. In their daily life and their rituals their painted bodies expressed the living force of their cosmos, an originary energy that occurred at the limit of what one may call art and nature. In engaging Klee’s painting and drawing, one (...) is brought to such an open space of living transformative movement; one finds a place wider than our present imagination, a time-space that in our being exposed to his works and experience remains for us to inhabit. The letter from Arius to Alexander of Alexandria, also known as «Arius’ profession of faith», has been transmitted in its original language, Greek, by Athanasius (De Synodis) and Epiphanius (Panarion). Also, Hilary of Poitiers quotes a Latin translation of the letter twice (De Trinitate IV and VI). The comparative study of the two Greek versions and the Latin translation reveals small textual variants, which points to the independence of the three testimonies. The textual variant (κτιστὴν, instead of κριτὴν) is the (...) most interesting; it comes from a Greek version that has not been preserved. However, our work has been able to reconstruct this lost textual variant using an ancient and forgotten conjecture of Erich Klostermann. (shrink)

This article examines the little-known sculptures of pathology created by Doctor Paul Richer (1849–1933) in the 1890s for the so-called Musée Charcot at the Hôpital de la Salpêtrière in Paris. Under the direction of Doctor Jean-Martin Charcot (1825–1893), one of the founders of modern neurology, Richer was the head of the hospital's museum of pathological anatomy, as well as the Salpêtrière's resident artist. His ‘series of figural representations of the principal types of nervous pathology’ included busts of patients suffering from (...) labio-glosso-laryngeal paralysis and myopathy, as well as sculptures depicting patients with Parkinson's disease and juvenile hypothyroidism. These patient portraits were seen as objective, while also paradoxically providing an alternative to mechanical media, such as the photograph and the cast, by permitting the doctor's intervention in not only controlling and animating the sitter, but also emphasising the patient's symptoms. This was a new kind of medical specimen: the ‘scientific artwork’, as they were called by a contemporary. This phrase, far from being an oxymoron, indicates the purposive collapse of the objective (‘scientific’) and subjective (‘artistic’) binary in Richer's sculptures of pathology. Through a detailed examination of three of Richer's works, this article problematises the categories traditionally used to describe, analyse and understand medical imagery and complicates our understanding of the relationship between science and art at the end of the nineteenth century.
